Standard Customer Terms and Conditions

Who Loves That (EL Briggs and E Clapham TA Who Loves That, ABN 84 670 702 175) acts as a platform to allow purchases between sellers and buyers and is therefore an agent. We cannot be responsible for the information our sellers supply and have no part in the purchases between our sellers and buyers.

Our website includes products available to purchase from various sellers. If you place an order for a product on our website, you are placing an order with the Seller of the product and not us. We make the products available for purchase as the agent of the seller, and not on our own behalf.

When you place an order and complete checkout you are forming a contract to purchase the item in your basket. If a seller accepts your order for the purchase of a Product, then an agreement is formed between you and the seller and you have the rights directly and only against the Seller, and not Who Loves That. We are not a party to that agreement.

Sellers can modify or discontinue an item prior to checkout and it is your responsibility to ensure the item is as originally selected prior to purchase.

As a buyer, it is also your responsibility to make sure that you are legally entitled to fulfill checkout on any item you purchase.

Please read each stores T&C’s and refund policies if you are not sure at any time.

PAYMENT

  • You agree to pay the purchase price specified on the website at the time you placed the order as well as any applicable shipping and insurance charges based on the shipping options selected by you. All amounts are stated in Australian Dollars. All purchase prices include Australian GST (where applicable).
  • You must pay for the product online by your PayPal account. Your payment will be processed upon receipt of your order. The credit cards that are accepted will be described on the website. A surcharge may apply for the use of certain credit cards, and where this is the case this will also be described on the website.

CANCELLATION OF ORDERS

  • The Seller may cancel an order that it has already accepted if the Seller suspects that you are acting fraudulently (such as using a credit card without proper authorization) or in breach of these terms.
  • While the Seller endeavors to avoid pricing and other errors, inadvertent errors do occur from time to time and the Seller may also cancel an order that it has accepted in such circumstances.
  • Unforeseen supply issues or unexpected demand may occasionally result in the Product being unavailable. If there is a delay in shipping your order the Seller will contact you as soon as possible to advise you of the reason for the delay. If this occurs, you may cancel your order at any time prior to when the Seller ships the Product to you.
  • You may also cancel an order if the Seller is in breach of these terms.

DELIVERY 

On receipt of payment the Seller must fulfill the order within 3-5 business days unless specified in the Sellers delivery terms or unless advised by the Seller.

SHIPPING

a. Delivery is FREE Australia Wide, however some Sellers may charge a small shipping fee for certain larger items or orders. If a product is delivered FREE this is clearly displayed on each product page, otherwise the shipping cost is displayed at checkout.

b. If the goods are being delivered outside of Australia, you must pay any other sales, use, goods and services, value added, customs, excise or similar taxes or charges imposed by any applicable government agency. The Seller is unable to advise you on the amount of any other taxes, and you should contact the taxing authorities of the country the products are to be shipped too if you are unsure.

RETURNS

The Seller is to state their refund terms and conditions on their individual shop page and it is the Buyers responsibility to read the T&C’s.

Who Loves That is entitled to amend the Terms and Conditions, the Fees and the Policies, all or any of them by posting amended versions of them on the website. It is the users responsibility to be aware of changes to the T&C’s of Who Loves That.
